Professional Experience

Brent T. Winder is the founder of Winder Intellectual Property Law. After over two decades working for a large, regional law firm, and seeing the winds changing in the legal market, Brent saw an opportunity to begin an adaptable and customer service - driven firm that allows him to provide sophisticated, large - firm styled legal services but, with considerably lower overhead obligations, at a substantially lower cost.

Brent is a registered patent attorney and has prepared and prosecuted U.S. and international patent applications in a variety of technologies, including herbal therapeutic formulations, biotechnological diagnostic instruments, business methods, software - driven educational processes, crafting tools, oil and gas mining equipment, mineral extraction methodologies and soil and groundwater remediation systems.

Brent has represented hundreds of local, national, and international businesses in acquiring and protecting U.S. and international trademark rights in proceedings before the U.S. Patent and Trademark Office, the Trademark Trial and Appeal Board and the World Intellectual Property Organization.

Brent has advised a wide range of clients, from start - up companies to global franchisors and direct sellers, on U.S. and foreign patent, trademark and copyright acquisition and enforcement strategies. He has regularly participated and consulted in litigation and pre - litigation disputes regarding patent, trademark and copyright infringement and trade secret misappropriation for both plaintiff and defendant clients. He has successfully represented and advised clients in acquiring domain names through proceedings under the Uniform Domain Name Dispute Resolution Policy.

Brent regularly conducts trademark clearance, patentability, and freedom to operate searches and provides opinions with respect to the same. He has also negotiated and drafted patent, technology, trade secret, copyright, domain name and trademark licenses, purchase agreements, assignments, and SaaS agreements. He has also managed intellectual property due diligence in several multi - million - dollar acquisitions involving complex intellectual property transfers and licensing issues.

Brent manages the foreign intellectual property assets of his international clients and works closely with local counsel in procuring rights and strategic planning.

Licensing

Brent is a member of the Utah State Bar and is registered to practice before the United States Patent and Trademark Office.

Educational Background

Brent attended the University of Utah and received a bachelor’s degree in Biology. After graduating from the University of Utah, Brent spent two and a half years working as a quality control chemist for an international calcium carbonate mining company. Brent received his Juris Doctorate degree from the University of Missouri - Kansas City School of Law. He also studied patent, trademark, and trade secret law at the Franklin Pierce Law Center (now the University of New Hampshire) in Concord, New Hampshire.

Community Involvement

Brent has lectured on intellectual property issues to various groups including the University of Utah Fine Arts Department; the Utah State University Research Foundation; and the Utah Chapter of the Entrepreneurs ’ Organization (EO). He also serves on a number of regional planning, development and utility boards and is the current mayor of Woodland Hills, Utah.
